Summary of the Data Processing Agreement

This agreement governs the processing of personal data between MSR Traffic GmbH (Data Processor) and the Client in the context of a service contract. Key points:

 

Responsibilities

The Client is responsible for the legality of the data processing, while the Data Processor processes personal data exclusively on the Client's behalf and according to the Client's instructions.

 

Types of Data

The data processed primarily includes user data such as names, email addresses, phone numbers, and IP addresses.

 

Protective Measures

The Data Processor must implement technical and organizational measures to protect the data in accordance with the GDPR, such as access and entry controls, encryption, and regular data backups.

 

Right to Issue Instructions

The Client may issue instructions for data processing, and the Data Processor must comply with these, including regarding the correction or deletion of data.

 

Subcontractors

The Data Processor may engage subcontractors who are subject to the same data protection provisions. One of the approved subcontractors is Hetzner Online GmbH (server and cloud services).

 

Liability

The Client is responsible for any damage resulting from unlawful data processing, unless the Data Processor can prove that they are not responsible for the damage.

 

Termination and Return

After the contract ends, all personal data must be deleted or returned. However, the agreement remains valid even after the main contract ends.
